Garmin Tournament Rewards
Summary
The top placing angler of a Garmin-sponsored fishing tournament that is part of the Garmin Tournament Reward program, from a boat equipped exclusively with mounted Garmin marine electronics will receive a $300 reward. The top placing angler at such Tournament with a Garmin Force Trolling Motor installed will receive a $200 reward. Canada tournament winners will be paid in U.S. dollars. To qualify for the Garmin Tournament Reward program, a tournament must have 20 boats or more participating. The Garmin Tournament Reward program is subject to all applicable federal, state, and local laws and regulations and is void where prohibited by law.
Rules
Qualifying 2024 fishing tournaments sponsored by Garmin International, Inc. (“Garmin”) (each a “Tournament”) are eligible for the Garmin Tournament Reward program. Not all Garmin sponsored tournaments are part of Garmin Tournament Reward program. The highest-placing finisher at each Tournament that exclusively has Garmin mounted equipment (as defined below) will win a Garmin Tournament Reward of $300 (the “Mounted Equipment Reward”) .The highest-placing finisher at each Tournament with a Garmin Force Trolling Motor mounted on such person’s boat will win a Garmin Tournament Reward of $200 (the “Force Reward”) (the Mounted Equipment Reward and the Force Reward each a “Garmin Tournament Reward” and, each winner of a Garmin Tournament Reward a “Garmin Tournament Reward Winner”).
Each Garmin Tournament Reward Winner must have been properly registered for the Tournament and be finally certified by the tournament director for such Tournament (each, a “Tournament Director”), in such Tournament Director’s sole discretion, as the highest-placing fisher in the Mounted Equipment Reward category or the Force Reward category, as the case may be. All decisions of the Tournament Director regarding each Garmin Tournament Reward Winner will be final and binding.
The boat from which the winner of the Garmin Mounted Equipment Reward fished must have been equipped with only Garmin fixed-mounted marine electronics (including Garmin GPS units, fishfinders, combo units, and chartplotters). The boat from which the winner of the Garmin Force Reward fished must have been equipped with a Garmin Force Trolling Motor. For avoidance of doubt, Garmin equipment mounted on another watercraft housed on the fishing boat or Garmin handheld or portable electronics do not qualify a boat as eligible for the Mounted Equipment Reward. Each Garmin Tournament Reward Winner must have fished from the same qualifying boat for the entirety of the Tournament.
Each Tournament Director will verify and decide, in such Tournament Director’s sole discretion, whether a fishing boat is equipped with the required Garmin equipment. The decision of the Tournament Director is final and binding.
The Mounted Equipment Reward and the Force Reward will be paid to the winner of such Reward by the Tournament Director on behalf of the Tournament. Payment will be made to each Garmin Tournament Reward Winner only. All federal, state and/or local taxes, and the reporting consequences thereof, are the sole responsibility of each Garmin Tournament Reward Winner.
Each Garmin Tournament Reward Winner must abide by all applicable laws and regulations, including fishing and boating laws and regulations.
By accepting a Garmin Tournament Reward, in addition to any other grants that may be granted in any other agreement entered into between a Tournament Director and Garmin Tournament Reward Winner, each Garmin Tournament Reward Winner grants Garmin and its affiliates, successors, assigns and licensees (collectively, the “Garmin Entities”) a perpetual, irrevocable, royalty-free, fully-paid, nonexclusive, worldwide, transferable, sublicensable right and license to use such Garmin Tournament Reward Winner’s name, likeness, and biographical information, the likeness of such Garmin Tournament Reward Winner’s property, and any photos that may be taken in connection with any Tournament in any format and for any purpose, including without limitation, advertising and promotional purposes, where permitted by law, and releases the Garmin Entities and the Tournament Director and their successors, assigns and licensees from any liability with respect thereto.
Acceptance of a Garmin Tournament Reward constitutes the Garmin Tournament Reward Winner’s full and unconditional agreement to and acceptance of these Garmin Tournament Reward Official Rules (these “Rules”) and the decisions of Garmin and the Tournament Director, each of which are final and binding.
To the maximum extent allowed under applicable law, by accepting a Garmin Tournament Reward, each Garmin Tournament Reward Winner agrees that the Garmin Entities (a) shall not be responsible or liable for any losses, damages or injuries of any kind resulting from participation in any Tournament or in any Tournament-related activity, or from such Garmin Tournament Reward Winner’s acceptance, receipt, possession and/or use of any Garmin Tournament Reward, and (b) have not made any warranty, representation, or guarantee, express or implied, in fact or in law, with respect to any Garmin Tournament Reward, and specifically disclaim all such warranties, including without limitation, the implied warranties of merchantability and fitness for a particular purpose. The Garmin Entities are not responsible for miscommunications or for any technical malfunctions, failures, or difficulties, printing errors, clerical, typographical or other error in the offering or announcement of any Garmin Tournament Reward or in any Garmin Tournament Reward notification documents, or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information. If any provision of these Rules is determined to be invalid or unenforceable, such provision will be modified and enforced to the maximum extent allowed under applicable law and these Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or unenforceable provision were not contained herein.
To the maximum extent allowed under applicable law, by accepting a Garmin Tournament Reward, each Garmin Tournament Reward Winner agrees that: (a) any and all disputes, claims and causes of action arising out of, or connected with, any Tournament or Garmin Tournament Reward shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Kansas; and (b) each Garmin Tournament Reward Winner waives the right to claim, and the Garmin Entities will have no liability to the Garmin Tournament Reward Winner or any third party for, any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages, including attorney’s fees. All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, each Garmin Tournament Reward Winner’s rights and obligations, or the rights and obligations of Garmin in connection with any Tournament or Garmin Tournament Reward, shall be governed by, and construed in accordance with, the laws of the State of Kansas, without reference to its conflict of law principles.
